The Best Interest of the Child Standard

Generally, in order to move more than 100 miles within the state of Michigan or anywhere outside its borders, a custodial parent must obtain the permission of a family court judge or the prior written consent of the other parent. To do that, the parent who wants to move must demonstrate that the proposed relocation meets the five test factors utilized in Michigan.

Some of the facts considered by courts to assist in ruling on relocation cases include better jobs, lower crime rates, health conditions and more affordable housing. However, even when those reasons exist, any move that might jeopardize the relationship the children have with their non-custodial parent stands a good chance of being rejected — unless the non-custodial parent hasn't been visiting or supporting the children.
