First, it may be possible to keep your home in either a Chapter 7 or a Chapter 13 bankruptcy. To do this in a Chapter 7, you must be current on your payments or be able to get caught up immediately or enter into a restructured mortgage. We are experienced at restructuring your mortgage and entering into reaffirmation agreements to help you retain your home.
There are non-bankruptcy options to consider as well. For instance, if you want to keep your home but have been having trouble making your monthly payments ever since the adjustable rate mortgage (ARM) was "adjusted" — we may be able to negotiate a home loan modification from your lender.
On the other hand, if it makes sense to walk away, a deed in lieu of foreclosure or a short sale without recourse, may provide the debt relief you need, keep your house and to keep a foreclosure off of your credit history at the same time.
